Terms of Service

Welcome to abuntech.com (the “Site”), operated by Beyond Fruitful Inc., a California corporation doing business as Abuntech (“Abuntech,” “we,” “us,” or “our”). These Terms of Service (“Terms”) govern your access to and use of the Site. By visiting or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

These Terms describe our website only. If you are a client receiving managed IT, security, or AI services from us, your services are governed by your signed Managed IT, Security & AI Services Agreement (“Agreement”), and that Agreement controls over these Terms for anything related to service delivery, pricing, term, termination, or liability for the Services themselves.

1. Who We Are

Abuntech is a managed IT, security, compliance and AI services provider based at 2621 Green River Rd., Suite 105-233, Corona, CA 92882.

2. Use of the Site

You may browse the Site and use its contact, quote-request, and scheduling features for legitimate business purposes. You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;
  • Attempt to gain unauthorized access to the Site, our systems, or any account;
  • Interfere with the Site’s operation (including by introducing malware, scraping content at scale, or overwhelming our servers);
  • Copy, reproduce, republish, or create derivative works from Site content without our prior written consent; or
  • Misrepresent your identity or affiliation when submitting a form, chat message, or quote request.

3. Quotes, Proposals, and Forms

Any quote, pricing estimate, or proposal displayed on or generated through the Site is for informational purposes only and is not a binding offer. A binding commitment for Managed IT, Security & AI Services is created only when both parties sign a Managed IT, Security & AI Services Agreement (including its Exhibits). Submitting a contact form, quote request, or scheduling request does not, by itself, create a client relationship or any obligation for Abuntech to perform services.

4. Accounts and Portals

If we provide you with credentials to a client portal, documentation hub (e.g., Hudu), or similar tool as part of the Services, you are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at [email protected] if you suspect unauthorized use.

5. Intellectual Property

The Site and its content — including text, graphics, logos, service descriptions, and underlying code — are owned by Abuntech or our licensors and are protected by copyright, trademark, and other intellectual property laws. Except as expressly permitted, no license is granted to you to use any Abuntech trademark, logo, or content. This mirrors the ownership approach in Section 10 of our Managed IT, Security & AI Services Agreement, which governs Work Product created in the course of delivering the Services.

6. Third-Party Links and Tools

The Site may link to, or embed, third-party tools (for example, scheduling widgets, chat, or payment/billing portals operated by our processors). We do not control and are not responsible for the content, policies, or practices of third-party sites or services. Your use of those tools is subject to their own terms and privacy policies.

7. Disclaimer of Warranties

The Site and its content are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the extent permitted under California law (Cal. Com. Code § 2312 et seq.). We do not warrant that the Site will be uninterrupted, secure, or error-free.

8. Limitation of Liability

To the maximum extent permitted by law, Abuntech will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Site. Because the Site itself is offered free of charge, our total liability arising from use of the Site will not exceed one hundred dollars ($100). This Section does not apply to Services delivered under a signed Managed IT, Security & AI Services Agreement, which are instead governed by that Agreement’s Section 14 (Limitation of Liability).

9. Indemnification

You agree to indemnify and hold Abuntech harmless from claims, damages, and reasonable expenses (including attorneys’ fees) arising from your misuse of the Site or violation of these Terms.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. The Parties will first attempt good-faith resolution of any dispute. If unresolved, disputes will be submitted to non-binding mediation in Riverside County, California, and, if mediation fails, to binding arbitration in Riverside County, California under the rules of the American Arbitration Association, consistent with the dispute resolution process in Section 20 of our Managed IT, Security & AI Services Agreement. Any claim must be brought within one (1) year of the date it arises (Cal. Code Civ. Proc. § 340).

11. Changes to These Terms

We may update these Terms from time to time. The “Effective Date” above reflects the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
